1. Acceptance of Terms

By accessing or using the Fireside Embroidery and Customization LLC (“Fireside Embroidery,” “we,” “our,” or “us”) website or purchasing goods or services from us, you agree to be bound by these Terms and Conditions. If you do not agree with these terms, you should not use our website or services.

2. Services We Provide

Fireside Embroidery provides the following services:

A. Embroidery Services

  • Custom embroidery
     
  • Bulk and contract production
     
  • Digitizing services (if applicable)
     
  • Related consulting and design recommendations
     

B. DTF (Direct-to-Film) Printing and Heat-Pressed Garments

We also offer DTF digital printing and heat-press application, including:

  • Full-color digital transfers
     
  • Heat-pressed application onto garments and accessories
     
  • Small-run, mid-run, and bulk-run options
     

DTF printed products are custom-made items. The same approval, payment, and refund rules that apply to embroidered goods also apply to DTF orders unless otherwise stated.

C. Service Modifications

All services are provided on a quote-and-approval basis.
We reserve the right to modify or discontinue any service at any time without prior notice.

3. Quotes, Orders, and Approvals

A. Quote Requests

Quotes are estimates based on the information you provide.
Pricing may change if artwork, garment type, stitch count, print size, or order quantity changes.

B. Customer Approvals

Customers are responsible for reviewing and approving:

  • Artwork proofs
     
  • Stitch samples (for embroidery, when applicable)
     
  • Print proofs (for DTF)
     
  • Quantities, colors, garment selections, and placement details
     

Once approved, the order moves into production and cannot be changed without additional cost.


Delays in customer approval may extend the estimated turnaround time. 

C. Custom Nature of Goods

Because embroidered and DTF items are custom-produced, all sales are final except in cases of verified manufacturing error.

D. DTF Artwork Requirements

For DTF printing, customers must submit artwork that meets required quality standards:

  • High-resolution artwork (generally 300 DPI preferred)
     
  • Transparent backgrounds when needed
     
  • Proper sizing and layout
     

We are not responsible for print quality issues resulting from low-resolution files, poor color contrast, or improperly prepared artwork. 

4. Payments and Billing

A. Payment Requirements

We may require:

  • A deposit before production
     
  • Full payment before pickup/delivery
     
  • Payment before ordering blank garments
     

Terms will be stated at the time of quoting.

B. Payment Processing

Payments may be processed through third-party providers such as:

  • QuickBooks Payments
     
  • Square
     
  • Stripe
     
  • PayPal
     
  • Our bank’s merchant services provider
     

By submitting a payment, you agree to the processor’s terms.

C. Late Payments

Invoices not paid by the stated due date may incur late fees or result in production delays.

5. Cancellations and Refunds

A. Customer Cancellations

Orders may be cancelled before approval and before any materials or garments are purchased.

Once garments are ordered or production begins:

  • Cancellations are not allowed
     
  • Deposits may be forfeited
     
  • The customer is responsible for garment/material costs
     

B. Refunds for Embroidery

Refunds are only provided when:

  • There is a confirmed embroidery error caused by our production
     
  • The item does not match the approved stitch sample or proof
     

Refunds are not provided for:

  • Customer errors in supplied artwork
     
  • Wrong sizes chosen by the customer
     
  • Wear-and-tear or improper care


 Minor variations in color, alignment, or embroidered appearance are considered normal and are not grounds for refund.
 

C. Refunds and Reprints for DTF Printing

We may offer a reprint or replacement if:

  • Print placement, size, or design does not match the approved proof
     
  • There is a confirmed production defect (e.g., incomplete adhesion)
     

Refunds/reprints are not offered for:

  • Low-resolution artwork submitted by the customer
     
  • Color differences between screens and printed results
     
  • Damage caused by improper washing or garment care


 Minor variations in color, alignment, or print appearance are considered normal and are not grounds for refund.
 

6. Turnaround Times and Production Scheduling

Turnaround times depend on:

  • Order size
     
  • Artwork complexity
     
  • Garment or material availability
     
  • Seasonal demand
     

Estimated delivery dates are not guaranteed, though we will make every effort to meet them.
We are not liable for delays caused by suppliers, shipping carriers, or unforeseen circumstances.

7. Customer Responsibilities

Customers must:

  • Provide accurate contact, artwork, and order details
     
  • Confirm all information before production
     
  • Ensure they have legal rights to all provided artwork
     
  • Follow garment care instructions
     

A. Embroidery Care Requirements

Follow the care instructions provided to avoid damage, distortion, or premature wear.

B. DTF Heat-Pressed Garment Care

DTF print care requires:

  • Cold wash
     
  • Inside-out washing
     
  • No bleach
     
  • Low-heat or hang drying
     
  • No ironing directly on the design
     

We are not responsible for damage caused by improper care.

8. Intellectual Property

A. Artwork Rights and Customer Representations

By submitting artwork, logos, or designs for embroidery or DTF printing, the customer represents and warrants that:

  • They own the copyright or
     
  • They have obtained all necessary licenses or permissions to reproduce the artwork on physical products.


  • They grant Fireside Embroidery a limited license to use the artwork solely for fulfilling your order.
     

Fireside Embroidery relies on the customer’s representations and may or may not independently verify copyright ownership.

B. Shared Liability and Indemnification

While both the customer and Fireside Embroidery may be legally exposed in the event of copyright infringement, the customer agrees to:

  • Assume full responsibility for ensuring that artwork they provide does not infringe any third-party rights
     
  • Indemnify, defend, and hold harmless Fireside Embroidery, its members, partners, and employees from any claims, damages, or legal expenses arising from the reproduction of customer-supplied artwork
     

This clause does not waive any legal obligations on the part of Fireside Embroidery but ensures that responsibility for the artwork’s legality rests with the submitting party.

C. Right to Refuse Artwork

Fireside Embroidery reserves the right to refuse any artwork that appears to violate copyright, trademark, or other intellectual property laws.

D. Fireside Embroidery Intellectual Property

All digitizing files, stitch files, print files, production files, and related notes remain the intellectual property of Fireside Embroidery unless otherwise agreed in writing.

E. Website Content

All website content (text, images, branding, layout) may not be copied or redistributed without written permission.

9. Prohibited Conduct

You agree not to:

  • Engage in unlawful activity
     
  • Submit defamatory, hateful, or inappropriate content
     
  • Attempt to disrupt or damage the website
     
  • Use automated tools (bots, scrapers) without permission
     
  • Impersonate another individual or business
     

We may refuse service to anyone who violates these rules.

10. Limitation of Liability

To the fullest extent permitted by law:

  • Fireside Embroidery is not liable for indirect, incidental, or consequential damages
     
  • Our liability is limited to the amount paid for the specific order
     
  • We are not responsible for website downtime, errors, or inaccuracies
     

This limitation applies even if we have been advised of possible damages.

11. Warranty Disclaimer

All products and services are provided “as is” without warranties of any kind, including:

  • Merchantability
     
  • Fitness for a particular purpose
     
  • Non-infringement
     

We do not guarantee:

  • Website availability
     
  • Error-free operation
     
  • Accuracy of website information
     

12. Indemnification

You agree to indemnify and hold harmless Fireside Embroidery and its members, partners, employees, and agents from any claims arising from:

  • Your use of the website or services
     
  • Your breach of these terms
     
  • Your submission or misuse of copyrighted artwork
     

13. Account Management (If Accounts Are Added Later)

If user accounts or ordering portals are implemented, we reserve the right to:

  • Suspend or terminate accounts
     
  • Restrict access for violations
     
  • Remove inappropriate content
     

This applies only if future account features are added.

14. Governing Law

These Terms and Conditions are governed by the laws of the State of New York.
Any disputes will be resolved in courts located in New York.

15. Changes to These Terms

We may update these Terms at any time.
The “Last Updated” date will reflect any changes.
Continued use of our site or services constitutes acceptance of updated Terms.

Return and Refund Policy

 

Return and Refund Policy

Fireside Embroidery and Customization LLC

At Fireside Embroidery and Customization LLC, every item we produce is custom-made specifically for you. Because custom products cannot be resold, most orders are non-returnable and non-refundable except in cases of verified manufacturing error.

This policy explains when returns or reprints are available, how to initiate a claim, and what conditions apply.

1. Custom Orders Are Non-Returnable

All embroidered and DTF-printed items are produced to your specifications. For this reason:

  • We do not accept returns for size issues, color preferences, or buyer’s remorse.
     
  • We do not accept returns for artwork errors provided by the customer.
     
  • Items cannot be returned once they have been customized, washed, worn, or altered.
     

This is standard practice for custom decorated apparel.

2. Eligible Returns or Reprints (Manufacturing Errors Only)

Once a proof is approved, the final product will match the approved proof as closely as possible within normal production tolerance. 


A return, refund, or reprint may be offered if the issue is due to a mistake on our part, including:

Embroidery

  • Incorrect thread colors (not matching approved proof)
     
  • Incorrect logo or placement
     
  • Significant defects in stitching
     
  • Product that does not match your approved sample or proof
     

DTF (Direct-to-Film) Heat-Pressed Printing

  • Incorrect print size, placement, or design compared to the approved proof
     
  • Production defects such as incomplete adhesion or large print distortions
     

3. Issues That Are Not Eligible for Refund or Reprint

For Embroidery

  • Customer-supplied artwork errors
     
  • Incorrect garment sizes or colors chosen by the customer
     
  • Thread or stitch variations within normal tolerance
     
  • Wear-and-tear or improper garment care
     
  • Minor variations in color, alignment, or embroidered appearance
     

For DTF Printing

  • Low-resolution artwork provided by the customer
     
  • Pixelation, blurring, or color shifts caused by poor original artwork
     
  • Differences between on-screen colors and printed colors
     
  • Damage caused by improper washing or heat exposure
     
  • Minor variations in print color, alignment, or appearance
     

These conditions reflect normal limitations of custom decorated apparel production processes.

4. Condition of Returned Items (If Return Is Authorized)

If a return is approved:

  • Items must be unworn, unwashed, and unaltered
     
  • Items must be returned exactly as received
     
  • All original packaging must be included (if applicable)
     

If the item shows signs of use or damage unrelated to production, the return will be denied.

5. How to Request a Return or Reprint

If you believe your item contains a manufacturing error:

Step 1 — Contact Us Within 7 Days

Email info@firesideembroidery.com within 7 days of receiving your order.

Include:

  • Your order number
     
  • A description of the issue
     
  • Clear photos of the defect
     
  • A photo of the full garment
     
  • A close-up photo of the affected area
     

Claims submitted after 7 days may not be eligible for return or reprint.

Step 2 — Evaluation

We review your photos and order details to determine:

  • Whether the issue is a manufacturing error
     
  • Whether a reprint, replacement, or refund is appropriate
     

Step 3 — Resolution

If approved, we will:

  • Reprint or replace the affected items, or
     
  • Issue a refund (in rare cases where a replacement is not possible)
     

Refunds are issued using the same payment method used for the order.

6. Refund Processing Timeline

Once a return or refund is approved:

  • Reprints are typically produced within 5–10 business days
     
  • Refunds typically process within 5–7 business days
     
  • Shipping times vary depending on location
     

7. Shipping Errors or Damaged-In-Transit Items

If your order arrives damaged due to shipping, notify us within 48 hours with photos.

We will assist in filing a carrier claim and determining next steps.
